§ 37-125. When cut to be permitted.

  • No curb shall be removed or omitted for a driveway entrance except at such location and at such grades as shall be designated by the city engineer and in accordance with the following provisions, nor shall any driveway, pavement, walks, curb, or gutter be cut or altered for repair or installation of subsurface utilities except in accordance with the following provisions:

    (1)

    When any curb or curb and gutter section is removed and is not to be replaced with a similar section, the same shall be replaced, without unreasonable delay, by a complete driveway section in accordance with regulations herein prescribed. The curb opening shall be protected by a slab of Portland cement concrete extending a maximum of five feet behind the face of the curb. The slab shall be laid on the same grade to conform to all provisions as would be required if a complete driveway section was being constructed. In cases where the elevation of private property is below the top of the curb elevation or other unusual conditions exist, the grade of the protective slab shall be as prescribed by the engineering division of the department of operations.

    (2)

    When any curb cut, not to be replaced by a similar section or a complete driveway section, is made and will subject any sidewalk to vehicular traffic, the sidewalk so subjected shall be replaced with a standard driveway sidewalk section.

    (3)

    When removing curb and gutter that has been constructed as a unit separate from the street surfacing, both curb and gutter shall be removed, provided that the curb only may be removed on any street constructed with a slip-formed curb and gutter dowelled to concrete pavement. When the limit of the section to be removed comes within five feet or less of any expansion or contraction joint, the curb and gutter shall be removed and replaced to the joint.

    (4)

    Prior to the removal of pavement for the installation or repair of subsurface utilities, all sides of the proposed cut shall be sawed with an approved concrete saw to a depth of not less than 1½ inches. Where it is necessary to cut paving for emergency repairs, paving may be removed without sawing, provided any damaged sections of paving are removed prior to making the repairs. After excavating and backfilling have been completed, if it is further necessary to remove additional paving, the sawing process shall be repeated, covering the outer edges of the paving to be replaced. When concrete paving is cut for the purpose of excavating, the cut in the concrete pavement shall be 12 inches wider than the excavation, allowing six inches of undisturbed earth on each side of the excavation.

    (5)

    Where a sidewalk is to be removed and replaced, a whole section of the sidewalk at the point involved shall be removed unless the cut is made with a concrete saw. When a sidewalk is cut for the purpose of excavating, the cut in the sidewalk shall be at least 12 inches wider than the excavation, allowing six inches of undisturbed earth on each side of the excavation.
