§ 3-17. Permitting or allowing gatherings where minors are consuming alcoholic beverages and any controlled dangerous substances.

  • (a)

    No person shall knowingly and willfully permit any individual under 21 years of age who is an invitee to the person's residence, any building, structure, or room owned, occupied, leased or otherwise procured by the person or on any land owned, occupied, leased or otherwise procured by the person, to possess or consume any alcoholic beverage or any controlled dangerous substance as defined in the Uniform Controlled Dangerous Substances Act, or any combination thereof, in such place.

    (b)

    A violation of this section shall be punished by a fine not exceeding $500.00 and costs, and/or by imprisonment not exceeding 90 days, or by both such fine and imprisonment.

    (c)

    It shall constitute an affirmative defense to a violation of this section if the conduct of the defendant would not constitute a violation of state law.
